Terms of Service

1. Acceptance of Terms
By accessing or using Evenseen ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service. Evenseen is operated by Evenseen Limited, a company registered in New Zealand.
2. Eligibility
You must be at least 13 years old to use the Service. By using the Service, you represent that you meet this requirement and have the legal capacity to enter into these terms.
3. Account Registration
You may create an account using your email address and password, or by signing in through Google or Facebook. You are responsible for maintaining the security of your account credentials and for all activity under your account.
4. User Content
You retain ownership of content you upload to the Service. By uploading content, you grant Evenseen a non-exclusive, worldwide, royalty-free licence to use, display, distribute, and process your content for the purpose of operating the Service, including:
- Displaying content in event timelines and feeds
- Generating AI-powered highlights from event content
- Creating thumbnails and previews
- Delivering content via our CDN
You must not upload content that is illegal, infringes third-party rights, or violates community standards.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Upload harmful, abusive, or inappropriate content
- Attempt to access other users' accounts
- Interfere with the Service's operation or security
- Use automated tools to scrape or collect data
- Impersonate another person or entity
6. Intellectual Property
The Service, including its design, code, branding, and AI-generated highlights, is owned by Evenseen Limited. You may not copy, modify, or distribute any part of the Service without our written permission.
7. Third-Party Authentication
When you sign in using Google or Facebook, you authorise us to access limited profile information (name and email) for account creation and authentication. We access only:
- Google: Name, email address, profile picture (scopes:
email,profile,openid) - Facebook: Name, email address (permissions:
public_profile,email)
You can unlink a social provider from your account at any time through your account settings, provided you have at least one other sign-in method configured (password or another provider).
8. Data Handling and Deletion
We take your data rights seriously. You can request deletion of your data at any time using the methods described below.
8.1 Account Data Deletion
To delete your Evenseen account and all associated data, email us at:
privacy@evenseen.com
Include your account email address in the request. We will process your deletion within 30 days and confirm by email once complete.
8.2 Google Sign-In — Data Deletion
If you signed in with Google and wish to remove the connection:
- Sign in to your Evenseen account
- Go to Account Settings → Connected Accounts
- Click "Unlink" next to Google
- Optionally, revoke access from your Google Account permissions
When you unlink Google, we remove your Google provider ID and profile picture URL from our records. If you wish to delete your entire account, follow the account deletion process in section 8.1.
8.3 Facebook Sign-In — Data Deletion
If you signed in with Facebook and wish to remove the connection:
- Sign in to your Evenseen account
- Go to Account Settings → Connected Accounts
- Click "Unlink" next to Facebook
- Optionally, remove Evenseen from your Facebook App settings
When you unlink Facebook, we remove your Facebook provider ID from our records. If you wish to delete your entire account, follow the account deletion process in section 8.1.
8.4 What Gets Deleted
When you request full account deletion, we permanently remove:
- Your profile information (name, email, avatar, bio)
- Your uploaded content (videos, photos)
- Your social connections (followers, following)
- Your event participation history
- Your linked social provider data (Google/Facebook IDs)
- Your session and authentication tokens
Some data may be retained for up to 30 days in backups before permanent removal. Anonymised, aggregated analytics data (e.g., total event attendance counts) may be retained as it cannot be linked back to you.
9. Service Availability
We strive to keep the Service available at all times but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Service at any time with reasonable notice.
10. Limitation of Liability
To the maximum extent permitted by New Zealand law, Evenseen shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you have paid us in the 12 months preceding the claim.
11. Termination
We may suspend or terminate your account if you violate these terms. You may delete your account at any time by following the process in Section 8. Upon termination, your licence to use the Service ends immediately.
12. Changes to Terms
We may update these terms from time to time. Material changes will be communicated via email or in-app notification at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
13. Governing Law
These terms are governed by the laws of New Zealand. Any disputes shall be resolved in the courts of Auckland, New Zealand.
